These Terms of Service (“Terms”) govern your use of the websites, applications, content, and related services provided by NovaBeautix LLC (“NovaBeautix”, “we”, “our”, or “us”). By using our services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the services.
1. About NovaBeautix
NovaBeautix LLC is a Wyoming limited liability company. Its principal and mailing address is 1007 N Orange St., 4th Floor, Suite 5166, Wilmington, DE 19801, USA. NovaBeautix operates the website at novabeautix.com and related digital services.
2. Eligibility and accounts
You must be at least 18 years old and legally able to enter into an agreement to use our services. If you act for an organization, you confirm that you are authorized to bind it. You are responsible for keeping your account information accurate and your credentials secure.
3. Acceptable use
You may use the services only for lawful purposes. You must not:
- Violate applicable law or another person’s rights;
- Access accounts, systems, or data without authorization;
- Disrupt, damage, reverse engineer, or misuse the services;
- Upload malware or deceptive, unlawful, or infringing content;
- Misrepresent your identity or your relationship with NovaBeautix or another party.
4. Content and intellectual property
NovaBeautix and its licensors own the services, branding, software, design, and content. We grant you a limited, revocable, non-transferable right to use the services for their intended purpose. You retain ownership of content you submit and grant us permission to process it only as reasonably necessary to provide, secure, and improve the services. You confirm that you have the rights needed to submit that content.
5. TikTok and other third-party services
Our services may connect with third-party platforms such as TikTok. Their own terms and policies also apply. If you connect an account, you authorize NovaBeautix to access and use the information made available by that platform only to provide the features you request and as described in our Privacy Policy. You may disconnect an integration through the relevant platform or by contacting us. NovaBeautix is not sponsored or endorsed by TikTok or another third-party platform unless expressly stated.
6. Cosmetic purpose; no medical advice
NovaBeautix provides beauty, cosmetics, self-care, and educational information. NovaBeautix does not provide any clinical or medical indication, and nothing in our websites, apps, devices, or other services is a diagnosis, treatment, or medical advice, or is intended to diagnose, treat, cure, mitigate, or prevent any disease or condition. The NovaBeautix services are not medical devices.
All sessions, routines, rituals, device programs and settings, schedules, tips, ingredient suggestions, Skin Insight results and summaries, assistant (Beautix) answers, notifications, and any other recommendation produced by the NovaBeautix app or any other NovaBeautix source are cosmetic in character and relate to the appearance, comfort, and everyday care of healthy skin. Suggestions of active ingredients and devices are based on published sources listed at novabeautix.com/science-sources; scientific support does not guarantee any result, and results vary from person to person.
Skin Insight is not a medical or dermatological skin assessment. It is a cosmetic, photo-based reading of visible characteristics that provides insights to improve and better adapt your cosmetic routine, so that you can follow changes over time. It cannot detect or rule out skin diseases or other medical conditions. Its results may be inaccurate: lighting, camera quality, makeup, freshly washed skin, the angle and distance of the photo, and other factors can influence them. Follow the photo tips shown in the app and use similar conditions each time. Only upload photos of yourself: you must not upload a photo of another person without that person’s consent. Automated or AI-generated information may be incomplete or inaccurate and should not replace professional judgment.
NovaBeautix does not sell, brand-endorse, or recommend specific active-ingredient products. Using its knowledge base, NovaBeautix indicates the type of active ingredient (the active principle) that published scientific documentation associates with a cosmetic goal; choosing, buying, and using a product that contains it is your decision. NovaBeautix does not assume responsibility for misuse of an active ingredient or product, or of a NovaBeautix device, meaning use contrary to the instructions and manual, the warnings and contraindications shown in the app, or the advice of your healthcare professional.
7. Your responsibility for how you use suggestions
You are responsible for deciding whether a suggestion is suitable for you. Do not accept or follow a recommendation if you are allergic or sensitive to an ingredient, material, or product, or if it may not be suitable because of any other clinical situation (for example pregnancy or breastfeeding, an implanted medical device such as a pacemaker, recent cosmetic or medical procedures, a skin condition, sunburn or open wounds, or medication that affects the skin). If you are unsure, consult a physician or dermatologist first. Perform a patch test before using a new product, follow the instructions for products and devices, stop use and seek care if you experience irritation, pain, or any adverse reaction, and answer the app’s questions truthfully because its safety rules depend on your answers. Report safety concerns to contact@novabeautix.com.
8. Availability and disclaimers
We may change, suspend, or discontinue features at any time. Pre-release and early-access features may change or never become generally available (see section 9). To the fullest extent permitted by law, the services are provided “as is” and “as available”, without warranties of uninterrupted availability, accuracy, merchantability, fitness for a particular purpose, or non-infringement.
9. Beta and early access program
While the NovaBeautix app is in its beta or early-access phase, the following also applies:
- Access. Access is by invitation or after we approve a request, and we release it in waves. We may approve, limit, pause, or end access at any time. Invitations and access are personal: do not share, resell, or transfer them.
- Pre-release software. The app and its features are still being tested. They may contain errors, change, be interrupted, or be removed, and some features may never become generally available. We do not promise any level of availability or results during this phase.
- Your data in the beta. Routines, schedules, history, and other data created during the beta may be changed, regenerated, reset, or deleted, for example when we improve the app’s safety rules or fix errors. We will try to tell you in advance when this affects you. You can delete your own data at any time in the app (Profile → Privacy and permissions) and at novabeautix.com/delete-account.
- Feedback. If you send feedback or suggestions, you allow us to use them to improve our services without obligation or payment to you. Personal data in feedback is handled under our Privacy Policy.
- Benefits. Benefits offered to early-access participants (such as discount codes or Skin Insight credits) have no cash value, are not transferable, and may be changed or withdrawn.
- Safety still comes first. Section 7 applies in full during the beta. The app is not for emergencies; if you have a reaction, stop use and seek care.
10. Limitation of liability
To the maximum extent permitted by applicable law, NovaBeautix and its members, officers, employees, and providers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the services, including damages resulting from not following instructions or warnings, from ignoring contraindications, or from inaccurate or omitted information that you provided. To the maximum extent permitted by law, our total liability for any claim relating to the services is limited to the greater of the amount you paid to NovaBeautix for the services in the twelve (12) months before the claim and one hundred U.S. dollars (US$100). Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including for fraud, gross negligence, or willful misconduct, or any mandatory consumer right in your place of residence.
11. Suspension and termination
You may stop using the services at any time. We may suspend or terminate access when reasonably necessary to address a violation of these Terms, unlawful conduct, security risk, or discontinuation of a service. Provisions that by their nature should survive termination will remain effective.
12. Governing law and disputes
These Terms, and any dispute arising out of or relating to them or to the services, are governed by the laws of the State of Wyoming, USA, and applicable U.S. federal law, without regard to conflict-of-law rules. Before starting a formal proceeding, please contact us at contact@novabeautix.com and give us thirty (30) days to try to resolve the matter informally. Subject to the next paragraph, the state and federal courts located in the State of Wyoming have jurisdiction over disputes that are not resolved informally.
Consumers. If you use the services as a consumer, nothing in these Terms removes the mandatory consumer-protection rights of the country where you live, including any right to bring a claim in the courts of your place of residence and to rely on the mandatory laws that apply there.
If any part of these Terms is found unenforceable, the rest remains in effect. Our not enforcing a provision is not a waiver of it. These Terms and the Privacy Policy are the entire agreement between you and NovaBeautix about the services.
13. Changes to these Terms
We may update these Terms as our services change. The current version and its effective date will be published on this page.
